Last updated: [DATE]. This is a draft pending legal review before Service Tracker opens to the public.
By creating an account or using Service Tracker ("the Service"), operated by Service Tracker Hoos Quarters ("we," "us," "our"), you agree to these Terms of Service on behalf of yourself and, if applicable, the company you represent ("Company").
Service Tracker is a field-service management platform: service order tracking, GPS-verified employee timeclock, inventory and procurement, customer invoicing and online payments, and an optional customer portal. Features available to your Company depend on your subscription plan.
Your Company’s administrator is responsible for the employee and customer-portal accounts created under your Company, for the accuracy of data entered, and for keeping login credentials secure. You must notify us promptly of any unauthorized use of an account.
Paid plans are billed on a recurring basis as described at signup. Fees are non-refundable except as required by law. We may change plan pricing with advance notice; continued use after a price change takes effect constitutes acceptance.
You retain ownership of the data you and your employees/customers enter into the Service ("Customer Data"). We use Customer Data only to provide and improve the Service, and will make it available for export on request.
The GPS Timeclock feature records device location at clock-in/clock-out (and, in strict-geofence mode, verifies proximity to the job site) when an employee uses it. See our Privacy Policy for details on how this data is collected, used, and retained.
The Service integrates with third-party providers — including Stripe for online payment processing and Gusto for payroll — to deliver certain features. Your use of those integrations is also subject to that provider’s own terms.
You agree not to use the Service to store or transmit unlawful content, attempt to breach its security, or interfere with other tenants’ use of the Service.
Either party may terminate this agreement as described in your subscription agreement. On termination, we will make Customer Data available for export for a limited period before deletion.
The Service is provided "as is." To the maximum extent permitted by law, Service Tracker is not liable for indirect, incidental, or consequential damages arising from use of the Service.
We may update these Terms from time to time. Material changes will be announced with reasonable advance notice.
These Terms are governed by the laws of [STATE/JURISDICTION], without regard to conflict-of-law principles.
Questions about these Terms can be sent to legal@servicetrackerhq.com.
